Automated Summary
Key Facts
Angelo Schillaci, a former regent of the 'Cosa Nostra' mafia family in Campofranco (Caltanissetta), faces charges of organizing eight extortion cases (both attempted and completed) and illegal possession of a weapon. The Tribunale di Caltanissetta confirmed his pre-trial detention on 13 June 2024, citing his role in reorganizing the mafia family post-2022 release and using extortion proceeds to fund the group's activities, including weapons and legal defense. The Corte di Cassazione declared his appeal inadmissible on 17 October 2024.
Issues
- The existence of aggravating circumstances for the mafia association, such as being armed and financing economic activities through criminal profits.
- Whether eight extortion charges (attempted and completed) were supported by sufficient evidence and properly linked to the mafia association's methods.
- Whether the defendant participated in a mafia association ('Cosa Nostra') as a regent, including evidence of reorganization efforts and financial activities tied to criminal proceeds.
- The court determined whether the appeal was inadmissible due to a lack of legal basis or manifestly illogical reasoning in the lower court's decision.
- The legal sufficiency of evidence for the defendant's illegal possession of a weapon and its connection to the mafia association's aggravating factors.
Holdings
- The court affirmed that the Tribunale's decision to confirm the custodial measure against Angelo Schillaci for mafia-related association and extortion was free from legal defects. The decision was based on evidence of Schillaci's role as a regent in the 'Cosa Nostra' organization and his involvement in orchestrating extortion activities.
- The court declared the appeal inadmissible, emphasizing that cassation appeals are only admissible when they denounce specific legal violations or manifest illogicality in the reasoning of the contested decision. The court reiterated that factual reconstruction or alternative interpretations of evidence cannot be addressed in cassation proceedings.
- The court dismissed the defense's arguments concerning the weapon detention charge, finding no concrete evidence to correlate Schillaci's involvement in the specific incidents. The defense's generic objections were deemed inadequate for cassation review.
- The court upheld the aggravating factors in the mafia association charge, noting the organization's armed status and its use of mafia methods (e.g., intimidation, subcontracting control). The defense's generic challenges to these factors were deemed insufficient under cassation standards.
- The court rejected the defense's claims regarding the extortion charges, stating that intercepted conversations were properly interpreted by the lower court and that cassation cannot reassess factual interpretations of evidence. The defense failed to demonstrate manifest illogicality in the Tribunale's reasoning.
Remedies
Monetary Damages
3000.00
Legal Principles
The court reaffirmed that in criminal matters, a cassation appeal is only admissible if it alleges a violation of specific legal provisions or a manifestly illogical motivation in the decision. It emphasized that differences in the evaluation of facts or evidence, which require a re-examination of the merits, fall outside the scope of cassation review. The decision cited prior jurisprudence confirming this principle.

Passage Text
