Automated Summary
Key Facts
Indigo Brand Holdings Proprietary Limited filed a trade mark application (No. 126776) in class 3 for 'non-medicated cosmetics and toiletry preparations' containing the mark 'I ♥' and 'i LOVE Vanilla' vertically arranged. The Trade Marks Examiner objected, claiming the mark comprises two separate elements. The Applicant argued the mark forms a cohesive expression, provided a blank space endorsement to prevent market confusion, and cited approvals in 16 other jurisdictions. The Assistant Registrar ruled the mark should proceed as filed, revoking the Examiner's objection but noting the mark must be used as registered to avoid consumer deception.
Issues
The primary issue was whether the Trade Mark Examiner's invitation to correct the application, based on the mark comprising two separate elements, was legally valid under the Trade Marks Act, Cap 506 of Kenya. The Applicant argued that the Examiner failed to specify the applicable legal provision and that the mark is used as a unified identifier in the marketplace. The ruling determined that the mark's elements formed a cohesive expression and should proceed as filed.

Legal Principles
The Assistant Registrar applied a purposive approach to the interpretation of the Trade Marks Act, Cap 506, focusing on the mark's function as a unified source identifier for the average consumer. The ruling emphasized that while the mark contains a blank space, its cohesive visual and conceptual arrangement prevents deception or confusion in the marketplace.

Passage Text
- It is my opinion that the said mark should be allowed to proceed for further examination as per the application filed. I have taken note of the practice in South Africa. However, I am of the view that trade marks should be used in the market as registered and the Applicant should therefore use the mark in the market as registered to avoid causing any confusion or deception in the marketplace.
- In considering the mark in question, the elements 'I ♥' and 'i LOVE Vanilla' are vertically arranged and in my view, they form a cohesive visual and conceptual expression. Although there is a blank space between the elements forming the mark, when considered as a whole, the representations communicate a single idea which the average consumer would interpret as a unified source identifier.
