Issues

The court addressed a succession dispute regarding the division of two parcels of land in the estate of Ndirangu Kiringa. The primary issues were: 1) the validity of excluding Caesar Mwangi Ndirangu from inheriting Parcel No. Kirimukuyu/Gachuiro/249 due to his status as a purchaser, and 2) the justification for allocating a larger share (1.7 acres) to Stephen Kiringa Ndirangu in the same parcel. Stephen argued he consolidated the property post-decease, paid fees, and assumed responsibility for educating younger siblings. The court confirmed the grant based on an unopposed affidavit, accepting these claims and validating the proposed division.
