Automated Summary
Deceased Name
Kaidongo Naimuye Passhu
Key Facts
The applicants, Yiasi Kaidongo Passhu and Koitutittei Passhu, seek to compel the District Land Registrar, Kajiado, to register land transfers for property title Kajiado/Kaputiei North/1428. The deceased, Kaidongo Naimuye Passhu, died intestate in 1991, and the applicants received a confirmed grant of administration in 1994. The applicants could not register the title due to a missing original deed and a caution placed by Washington Njoroge, who claimed a purchaser's interest. The court ruled the Land Registrar must register the transfer within 14 days, rejecting the registrar's reliance on a separate pending ELC case (No. 47 of 2018) as it does not involve the subject plot.
Issues
- The Land Registrar argued the matter should be resolved in the pending Kajiado ELC No. 47 of 2018. The court determined that the ELC case does not involve the specific plot (1428) at issue here and is not binding on the applicants or deceased, thus it does not preclude registration of the current transfers.
- The court addressed whether the District Land Registrar, Kajiado, is legally obligated to register the applicants' transfer of title (Kajiado/Kaputei North/1428) despite a caution registered by Washington Njoroge, and whether the Registrar can lawfully demand proof of subdivision from the applicants when the records should be in the Registrar's possession.
- The applicants challenged the validity of a caution registered by Washington Njoroge against the title, arguing he has no legitimate claim to the property. The court considered whether the cautioner’s interest (as a 'stranger to the estate') and the lack of subdivision records from the Land Registrar justify the caution.
Date of Death
1991 July 09
Holdings
- The court found merit in the applicants' application and directed the 2nd respondent (District Land Registrar, Kajiado) to register the transfers by way of submission or use documents lodged by the applicants in respect of property title number Kajiado/Kaputei North/1428 within fourteen (14) days of the ruling.
- The court clarified that any person with a claim to plot 1428 must file a suit in the Environment and Land Court (ELC) against the Administrators of the estate, emphasizing that the Land Registrar cannot act on behalf of cautioner Washington Karanja.
Remedies
The court directed the District Land Registrar to register the transfers by way of transmission submitted by the applicants regarding property title number Kajiado/Kaputei North/1428 within 14 days of the ruling.

Probate Status
Letters of Administration Intestate granted and confirmed on 24th February 1995
Legal Principles
The court emphasized that the Land Registrar, as custodian of land records under the Land Act 2012, cannot require applicants to provide documents that should already be in the Registrar's possession. It also clarified that any claims of illegal title acquisition must be addressed through criminal investigations, not administrative refusal. The court directed the Registrar to register the transfers and noted that third-party claims must be resolved via separate litigation in the Environment and Land Court.
