  • La misura di detta sanzione è rimessa alla discrezionalità del giudice e... non è necessaria una specifica e dettagliata motivazione... quando essa vi coincida, se ne allontani di poco o sia molto più vicina al minimo che al massimo.
  • L'applicazione della sanzione di che trattasi, tuttavia, costituisce statuizione obbligatoria, secondo quanto previsto dall'art. 186, comma 7, cod. strada («Salvo che il fatto costituisca più grave reato, in caso di rifiuto dell'accertamento... comporta la sanzione amministrativa accessoria della sospensione della patente di guida per un periodo da sei mesi a due anni...»).
