Automated Summary
Key Facts
The case involves Luna Residential III, LLC seeking mortgage execution against Jorge L. Hernández Miller for unpaid debts since July 2014, totaling $370,468.09 principal plus interest and fees. The property in question is located in San Juan, Puerto Rico (Las Flores de Montehiedra, lot 57). Multiple mediation attempts between 2018-2025 failed to reach an agreement. The lower court found no material factual disputes and ruled that Luna acted in good faith, a decision upheld by the appellate court.
Issues
The court addressed whether Luna Residential III, LLC fulfilled its legal obligation to negotiate in good faith during the mandatory mediation process required by Puerto Rico's Law 184-2012. The appellant argued that Luna rejected offers without proper consideration and failed to provide viable alternatives, while the court found that Luna demonstrated good faith by offering multiple repayment options and adhering to procedural requirements. The key question was whether the TPI properly determined that the creditor met the jurisdictional threshold for proceeding with mortgage execution after mediation attempts.
Holdings
The court held that the lower court did not err in denying the plaintiff's motion for summary judgment, as the creditor (Luna Residential III, LLC) demonstrated good faith in the mandatory mediation process required by Law 184-2012. The appellate court confirmed that Luna provided multiple viable alternatives to the debtor (Jorge L. Hernández Miller) to avoid mortgage execution, including short-sale options, loan modifications, and loss mitigation programs. The court concluded that the lower court properly exercised jurisdiction to proceed with the mortgage execution after exhausting reasonable mediation efforts.
Remedies
- The appellate court affirmed the lower court's decision to proceed with the mortgage execution, rejecting the appellant's claims of bad faith negotiation and confirming that all mediation requirements were met.
- The court ordered the execution of the mortgage, leading to the public auction sale of the property to satisfy the debt.
Legal Principles
The court emphasized that the creditor (Luna Residential III, LLC) was required to act in good faith during the mandatory mediation process under Puerto Rico's Law 184-2012. This principle dictates that mortgage creditors must offer all available market alternatives to debtors to avoid home loss, while ensuring negotiations are reasonable and evidence-based. The court concluded that Luna fulfilled this obligation by providing viable options and rejecting unreasonable offers from the debtor.

Passage Text
