George Richards v Management of Bangso Fishing Company (IC 54 of 2018) [2019] SLHC 5 (14 March 2019)

SierraLII

Automated Summary

Key Facts

Plaintiffs George Richards and others claimed unpaid redundancy compensation, end of service benefits, and other entitlements from the Management of Bangso Fishing Company. The Ministry of Labour attempted mediation without success, leading to referral to the Industrial Court. The defendant failed to attend court proceedings, and the court ruled in favor of the plaintiffs, awarding the computed benefits as per the Ministry's assessment.

Issues

  • The court considered the legal implications of the Defendant's repeated failure to attend meetings and court sessions. The Defendant's absence allowed the court to proceed with judgment under the Industrial Court Act and Rules, as they did not present evidence or contest the Plaintiffs' claims.
  • The court addressed whether the Plaintiffs were entitled to non-paid redundancy compensation, end of service benefits, and other entitlements following the Defendant's failure to meet with the Ministry and subsequent absence in court. The issue centered on the legal obligation to pay terminal benefits and the validity of the Plaintiffs' claims under labor laws.

Holdings

The court determined that in the absence of evidence to the contrary, the plaintiffs (George Richards, Junisa James, and Suffian Sheick) have proved their case and are entitled to redundancy compensation, end of service benefits, and other entitlements as computed by the Ministry of Labour and Social Security. The total amounts awarded to each plaintiff are detailed in the provided table, including leave pay, annual leave allowance, redundancy notice, redundancy compensation, and end of service benefits.

Remedies

  • Additional entitlements such as Leave Pay and Annual Leave Allowance were awarded. George Richards received Le41,454,545, Soufian Sheick Le43,181,818, and Junisa James Le52,272,727 in Leave Pay, along with their Annual Leave Allowances of Le22,800,000, Le23,750,000, and Le23,000,000 respectively.
  • The court awarded redundancy compensation to the plaintiffs as computed by the Ministry of Labour and Social Security. The amounts include Le51,818,181 for George Richards, Le53,977,272 for Soufian Sheick, and Le57,500,000 for Junisa James.
  • End of Service Benefits were granted to the plaintiffs, with the same amounts as redundancy compensation: Le51,818,181 for George Richards, Le53,977,272 for Soufian Sheick, and Le57,500,000 for Junisa James.

Legal Principles

The court applied procedural principles allowing it to proceed and deliver judgment in the absence of the defendant who failed to appear despite multiple notices. The decision relied on the Industrial Court's authority under the Act and Rules to withdraw the file for judgment when the defendant does not contest allegations. The court accepted the plaintiffs' claims by default due to the defendant's failure to provide evidence or challenge the Ministry's computations of entitlements.
