Automated Summary
Key Facts
The deceased, Beatrice Munini Muthini, died from a head injury caused by an unlawful act. The accused, her son, was identified as the perpetrator through evidence from nine witnesses including her husband (PW2) who testified to the accused threatening to kill his mother for disapproving his church attendance. The husband found the deceased lying on the ground in their homestead with an injury to the back of her neck, confirmed by medical experts (Doctor PW7 and Pathologist PW8). The prosecution's case was proven beyond reasonable doubt, and the court ordered the accused to enter his defence under Section 306(2) of the Criminal Procedure Code.
Issues
- The court determined that the deceased's death was caused by an unlawful act, specifically an injury to the back of her neck as testified by multiple witnesses and confirmed by the pathologist and doctor.
- The court ruled that the accused must enter his defense under Section 306(2) of the Criminal Procedure Code, based on the evidence presented and the legal obligation to respond to the prosecution's case.
- The court concluded that the accused, identified as the deceased's son, was the person who committed the act based on witness testimony and his prior threats against the deceased.
Holdings
- The court concluded that the accused is the person who committed the murder. This was based on evidence showing the accused was present during the crime, had previously threatened to kill the deceased (the victim's mother), and the prosecution's witnesses confirmed the accused was the only individual in the homestead with the deceased at the time of the attack. The court found this to be sufficient evidence to place the accused as the perpetrator under Section 306(2) of the Criminal Procedure Code.
- The court determined that the death of the deceased was caused by an unlawful act, as corroborated by multiple witnesses including the deceased's husband (PW2), her brother-in-law (PW1), step sister (PW3), and medical experts (PW7 and PW8). The evidence established the deceased was found dead in her homestead, suffered a head injury on 2nd March 2021, and succumbed to her injuries on 24th March 2021 at Kenyatta National Hospital. The court concluded this was an unlawful act based on the location, timing, and eyewitness accounts of the assault.
Remedies
The court ordered the accused to enter his defense in accordance with Section 306(2) of the Criminal Procedure Code. This is a procedural remedy requiring the accused to present his defense after the prosecution's case is closed.
Legal Principles
- The court emphasized the standard of proof, requiring the prosecution to demonstrate the accused's guilt beyond a reasonable doubt. This standard was satisfied by evidence showing the deceased's death was caused by a head injury on 2nd March 2021, corroborated by multiple witnesses including the deceased's family members and medical professionals. The court concluded the evidence met this threshold, leading to the accused being placed on their defense under Section 306(2) of the Criminal Procedure Code.
- The court applied the principle that the prosecution must establish a prima facie case to compel the accused to defend themselves under Section 306(1) of the Criminal Procedure Code. The burden of proof requires the prosecution to prove the case beyond a reasonable doubt, which the court determined was met through evidence from multiple witnesses attesting to the deceased's injury and the accused's presence at the scene.

Passage Text
- My finding is that the first key point, the death of the deceased has been proved beyond reasonable doubt. The deceased's husband (PW2), her brother-in-law (PW1) and step sister (PW3) all attested to her death a fact which was also corroborated by the Pathologist (PW8) and a Doctor (PW7) who was part of the team that attended to the deceased during her hospitalization at the Kenyatta National Hospital.
- It is instructive that this offence occurred in broad daylight and at the homestead of the deceased where the accused who is her son also lived. PW2 testified that the deceased had just returned home from bringing her phone which she had taken to be charged. He also stated that he saw and heard the accused quarrelling with his mother. There was nobody else in the homestead save for the two of them and the accused had previously threatened to kill his mother.
