Key Facts
Elias Kiguha Marwa (Applicant) purchased a property from the late Salim Hamdun's administrators (2nd and 3rd Respondents) in 2012 for USD 1,050,000, paying Tsh 210,000,000. After administrators were revoked and the 4th Respondent became sole administrator, the property was sold to the 1st Respondent (Voxel Electrical & Decorators Ltd) in 2023. The Applicant sought an interim injunction to prevent transfer/distribution of sale proceeds, but the court dismissed the application, ruling this is a contractual dispute under the probate court's jurisdiction (Probate and Administration Cause No. 8 of 2010). The court cited section 50(1) of the Probate and Administration of Estates Act, stating payments to revoked administrators are legally binding.

Issues
- The Applicant sought a refund for payments made to revoked administrators of the deceased's estate, arguing the contract of sale should be enforced. The court highlighted that such claims must be addressed in the probate court, referencing section 50(1) and (2) of the Probate and Administration of Estates Act, which governs remedies for payments made to revoked administrators. The Applicant was directed to exhaust these remedies before the probate court, as the current application was deemed premature and outside the Land Division's jurisdiction.
- The court determined whether the High Court of Tanzania (Land Division) has jurisdiction over a contractual dispute arising from the sale of a deceased's property by former administrators, or if the matter should be resolved in the probate court. The ruling emphasized that questions related to estate administration, including contractual claims against revoked administrators, fall under the exclusive domain of the probate court, citing sections of the Judicature and Application of Laws Act and the Probate and Administration of Estates Act.
Holdings
The court dismissed the application for an interim injunction, determining that the Applicant's claims regarding a refund from a previous sale agreement are not within the jurisdiction of the High Court's Land Division. The court emphasized that such matters should be addressed in the probate court (Probate and Administration Cause No. 8 of 2010) as they pertain to contractual disputes and the administration of the deceased's estate, not land ownership disputes.
Remedies
The court dismissed the applicant's interim order application. The applicant was spared from paying foot costs.
Probate Status
Probate and Administration Cause No. 8 of 2010 is pending; Applicant has not exhausted remedies under section 50(1) and (2) of the Probate Act.
Legal Principles
The court held that disputes concerning the administration of an estate, including sales and distribution of proceeds, are exclusively under the jurisdiction of the probate court. It emphasized that the Applicant's contractual claims against former administrators should be resolved in the ongoing probate cause (No. 8 of 2010) rather than the land division court. This aligns with section 50(1) of the Probate and Administration of Estates Act, which states that payments made to revoked administrators are a legal discharge.
