- Condanna la parte ricorrente al pagamento, in favore della parte controricorrente, delle spese del giudizio di legittimità, che liquida in Euro 9.031,00 per compensi, oltre alle spese prenotate a debito.
- Considerato che è trascorso il termine di giorni quaranta dalla comunicazione della anzidetta proposta senza che la parte ricorrente abbia chiesto la decisione del ricorso;
- Ritenuto, pertanto, che – a norma dell'art. 380-bis, secondo comma, c.p.c. – il ricorso deve intendersi rinunciato e deve provvedersi a dichiarare l'estinzione del giudizio di cassazione ai sensi dell'art. 391 c.p.c.
