The victim left their home late at night and was dropped off by a boda boda operator, prompting the accused to confront her. During the altercation, the victim attacked him, leading to her death from fatal injuries sustained in the confrontation. The accused was granted a 3-year probationary sentence under Kericho County Probation Officer supervision.

Issues

The court addressed the legal question of whether Ronald Kipkorir's act of killing his wife Sharon Chepngeno under circumstances of perceived infidelity and provocation constituted manslaughter as defined by sections 202 and 205 of the Penal Code. Key issues included the validity of the self-defense claim, the role of the victim's behavior in provoking the accused, and the appropriateness of a non-custodial sentence given the probation officer's recommendation and the family's forgiveness.

Holdings

The court convicted Ronald Kipkorir of manslaughter under sections 202 and 205 of the Penal Code. The accused, who entered a plea bargain, was sentenced to 3 years on probation. The decision considered factors such as provocation by the victim, the accused's remorse, family forgiveness, and a pre-sentence report recommending probation with counseling.

Remedies

The accused was sentenced to serve 3 years on probation under the supervision of the Kericho County Probation Officer, following a non-custodial sentence recommendation from the pre-sentence report.

Legal Principles

The court considered the principle of self-defence in determining the sentence, noting that the accused retaliated after being attacked by the victim. The probation officer's report also highlighted the accused's actions were provoked by the victim's conduct.
