NAMONYA KIRIERI v PETER MALAI NYUMOO [2009] eKLR

Kenya Law

Automated Summary

Key Facts

The case involves a dispute between Namonya Kirieri (petitioner) and Peter Malai Nyumoo (objector) over the estate of Thirai Kabira. The petitioner claims the deceased died in 1968 and seeks a grant of representation for his estate, including land (L.R. No. NJIA/BURIERURI/1131). The objector, asserting the deceased was a woman who died in 2004, challenges the petition, alleging it is an abuse of court process. The objector claims he obtained a power of attorney in May 2004 and transferred the land to himself in July 2004. The court confirmed an inhibition order and injunction allowing the petitioner's family to occupy the land pending resolution, while the objector seeks to review these orders.

Deceased Name

Thirai Kabira

Issues

  • The court had to determine whether the deceased in the petitioner's claim (Thirai Kabira, who died in 1968) is the same person as the deceased in the objector's claim (a woman who died in 2004), including discrepancies in the deceased's identity, gender, and death date.
  • Whether the court's orders (inhibition, injunction, and arrest for intermeddling) are appropriate to resolve the conflicting claims over the land, and whether the status quo should be maintained pending further proceedings.
  • The validity of the objector's title to the land (L.R. No. NJIA/BURIERURI/1131) under a power of attorney dated 5th May 2004 and a subsequent transfer on 7th July 2004 for Kshs. 30,000, including whether the transfer was lawful and if the objector's registration of title is valid.

Holdings

  • The order of inhibition granted on 11th July 2005 was confirmed pending the hearing of the objection. No further orders were made regarding costs.
  • The court ordered the parties to maintain the status quo on the suit land pending the hearing of the objection. No party was granted the right to evict another, and farming activities were to continue on their respective portions of the land as previously arranged.

Remedies

  • The court issued an injunction to restrain the objector from interfering with the peaceful occupation of the suit land and house by the petitioner and her family until further orders.
  • The court confirmed the order of inhibition granted on 11th July 2005, preventing the objector from interfering with the suit land pending the hearing of the objection.
  • Parties were ordered to maintain the status quo as of the ruling date, prohibiting evictions and requiring farming activities to continue confined to their respective portions of the land.

Probate Status

Probate contested due to conflicting claims over deceased's identity and land ownership.

Legal Principles

The court applied inherent powers under Rule 73 of the Probate and Administration Rules and Section 45 of the Law of Succession Act to issue an interim injunction, ordering the parties to maintain the status quo pending the hearing of the objection. Passage Text

  • The application before me is brought under the inherent powers of this court – Rule 73 of the Probate and Administration Rules and section 45 of the Law of Succession Act which prohibits intermeddling with the property of the deceased.
  • The order that appears to me to be favourable in the circumstances of this matter is that the parties to maintain the status quo as of the date of this order pending the hearing of the objection. For the avoidance of doubt, no party has a right to evict another and the farming activity on the suit land to continue as previously, confined to the respective definite portions of the suit land.
  • The order of inhibition granted on 11th July 2005 is confirmed pending the hearing of the objection. I make no orders as to costs.
