Automated Summary
Key Facts
The court initially declined the adoption of Shadrach Jason by David Lee Bill and Jennifer Susan Bell on 28 April 2023 due to incomplete compliance with the Children Act 2022. The applicants subsequently submitted required documents including missionary work certification (CSIM), Mahali Pa Maisha registration, Cincinnati Children's Hospital medical reports, and authorization from Indiana authorities. The court allowed the adoption on 28 September 2023, confirming Shadrach Jason Bell's Kenyan citizenship and appointing Elosy Ndumba as legal guardian.
Issues
- The Applicants submitted documents through adoption agencies but did not provide a medical report detailing the child's special needs or unique health conditions, which the court needed to assess their capacity to facilitate medical and cognitive development, including treatment abroad.
- The Applicants did not present legal documents of registration and proprietorship of Mahali Pa Maisha Rescue Home as required by Section 63(3) of the Children Act 2022, nor the extent of their involvement in running the home.
- The Applicants did not submit documents confirming their missionary work in Kenya, including any documents verifying the existence, scope, and appointment by Christian Services International Ministries (CSIM).
- The Form C5 court order from the Children's Court at Kajiado committing the child to Mahali Pa Maisha was not the same as the CM's Court Guardianship Order attached, leading to a discrepancy the court needed to resolve.
- The Applicants were required to provide reports from their home country's competent government authority or court confirming their authorization and recommendation as fit and financially capable to adopt a foreign child, as mandated by Section 191(d) of the Children Act 2022.
