Issues

The case addresses the criminal offense of defilement under section 129(1) of the Penal Code Act, where the accused, Ronald Mutebi, admitted to having non-consensual sexual intercourse with a 9-year-old victim, Christine Namaganda. The court considered the age difference between the 30-year-old accused and the minor victim, the violent nature of the act, and the societal impact of defilement. The judge emphasized the need for a deterrent sentence despite the accused's guilty plea, first-offender status, and time spent in remand.

Holdings

The court convicted the accused, Ronald Mutebi, of defilement under Section 129(1) of the Penal Code Act after he pleaded guilty. The judge sentenced him to six (6) years imprisonment, acknowledging mitigating factors such as his guilty plea, status as a first offender, and time spent on remand (two years and 11 months). The conviction was based on the victim's testimony and medical evidence confirming the sexual assault. The judge emphasized the seriousness of defilement, the harm to the victim (a 9-year-old girl), and the need for a deterrent sentence, though leniency was exercised due to the accused's cooperation and remorse.

Remedies

The convict is sentenced to six (6) years imprisonment. This period does not include the period he has been on remand.

Legal Principles

The court convicted the accused under Section 129(1) of the Penal Code Act for defilement. Key legal reasoning included the seriousness of the offense, the need for deterrent sentencing, and the rejection of the defense's claim that intoxication justified the crime. The judgment underscores that defilement is a strict liability offense with no leniency for mitigating factors like alcohol influence.

Nakate reported the sexual act between the accused and victim to Erivansoni Nakasi the mother of the victim. • The offence of defilement is so frequent and rampant that the public and society is crying foul about it. The death sentence as the maximum sentence for it has not achieved much to deter people from committing the offence. Courts must not give up the fight and crusade of combating the scourge by awarding stiff and deterrent sentences to those convicted of this offence.
  • Accused States: I admit the offence I agree I had sexual intercourse with her (Namaganda). Plea Guilty entered.
