Automated Summary
Key Facts
The Claimant (Henry Abuga Bosire Ongwae) obtained a favorable judgment on 2019-07-19. The Respondent (Ming Tribe International Group Limited) applied for a stay of execution, depositing Kshs 1 million as security. The stay was conditional on the Respondent filing an appeal within 60 days. Despite multiple court applications and dismissals (including on 2019-09-25, 2019-10-24, and 2019-11-19), the Respondent failed to institute an appeal within the prescribed period, leading to the abandonment of the intended appeal. The Claimant argued this delay caused financial distress over 515 days and constituted an abuse of the court process. The court ruled the appeal was deemed withdrawn, allowing the release of the decretal sum (Kshs 601,208/- as of 2021-06-03) and accrued interest to the Claimant.
Issues
- The claimant sought release of Kshs. 601,208/- and accrued interest held in court as security for the appeal, asserting the respondent's failure to prosecute the appeal justified releasing the funds to alleviate the claimant's financial distress from over 515 days of delay.
- The court had to determine if the respondent's delay in instituting an appeal (despite filing a notice of appeal in 2019) and subsequent 515-day period of inaction amounted to abandonment of the appeal. The claimant argued this delay caused serious pecuniary distress and abused the court process.
Holdings
The court allowed the application for the release of the balance of the decretal sum of Kshs. 601,208/- and accrued interest to the Claimant. The court found that the Respondent's failure to lodge an appeal within 60 days of the Notice of Appeal resulted in the abandonment of the intended appeal, thereby making the Claimant's motion for fund release meritorious.
Remedies
The court ordered the release of the balance of the decretal sum of Kshs. 601,208/- as at 3rd June 2021, along with any interest accrued, to the Claimant. This was deposited in the Court account following the Respondent's failure to pursue an appeal within the required timeframe, leading to the abandonment of the intended appeal.

Legal Principles
The court determined that the respondent's failure to lodge an appeal within 60 days of the notice of appeal, as per the court's conditional stay order, constituted abandonment of the appeal. This procedural default allowed the claimant to access the decretal funds, as the respondent was deemed to have withdrawn the appeal. The ruling emphasized adherence to court timelines to prevent abuse of the judicial process.

Passage Text
- It would seem that the Respondent never mounted an appeal despite the passage of time since November 2019. The stay given by the Court was conditional and having failed to lodge an appeal within 60 days as required by the Rules, the inevitable conclusion is that the intended appeal emanating from the Judgment herein was abandoned.
- It is the Applicant's assertion that despite the Respondent having lodged a Notice of Appeal, it has failed to institute an appeal which should have been lodged within 60 days from the date of lodging the Notice of Appeal. The Claimant posits that the delay, failure and neglect on the Respondent/judgment debtor amounts to abandoning the intended Appeal and in law the Respondent is deemed to have withdrawn the notice of appeal.
