- I find that the offer which was made by the National Bank and the defendant simply to try and bring what was considered to be a long and unnecessary dispute to an end, was accepted by the plaintiff, and thus a settlement reached, without force or undue influence.
- I find that the plaintiff has not proved the allegation that the defendant switched his tobacco.
- I prefer, on this aspect, the evidence of the defendant to that of the plaintiff and find that it was on the 4th June, 1984, when the 53 bales were delivered at the defendant's factory.
