Automated Summary

Deceased Name

MOSES MUYA KAGOCHA alias MUYA KAKUYA

Key Facts

The deceased, Moses Muya Kagocha (alias Muya Kakuya), died on 4/5/1999, leaving a non-contested estate administered by Grace Nyawira Kiama. The estate includes land parcels Konyu/Baricho/73 and Konyu/Baricho/714 (1.25 Ha) to be shared equally by his children. An application sought to distribute Ethan Maina Muya's share to his children, but Irene Wambui Maina objected, claiming she is the co-widow and that her daughter Anne should be included. The court ruled the dispute pertains to an heir's estate, not the original deceased's, expunged the 24/11/2017 application, and required a fresh petition for Ethan's estate. The administrator is directed to register Ethan's share in his estate's name pending succession, and the County Land Registrar must restrict dealings on his share.

Issues

  • Whether the court can proceed with distributing the estate of an heir (Ethan Maina Muya) without initiating formal succession proceedings in that heir's own estate, as opposed to the original deceased (Moses Muya Kagocha).
  • Whether the applicant, Grace Nyawira Kiama, is a valid co-widow of Ethan Maina Muya and if her daughter Anne Wanjiku should be recognized as a beneficiary in his estate, given the dispute over her status as a co-widow.
  • Whether the application for review was properly filed under the Probate and Administration Rules, particularly regarding compliance with objection timelines and procedures outlined in Rule 17(1) and Section 68.

Passage Text

  • Consequently, I expunge all proceedings and the application dated 24/11/2017. The beneficiaries of the estate should file a fresh petition for that estate and list all beneficiaries. They will, as usual, be published in the Kenya Gazette to welcome any objections in that cause not on the father's estate.
  • The Petitioner herein is the spouse of the Deceased. The Objector is a child of the Deceased. Contrary to the assertions of the Objector in his objection, he does not rank equally with his mother. The mother is a rank above him. He is not entitled in the same degree to administer the estate as his mother, and certainly has no priority over her. It was therefore not necessary for the Petitioner to give any notice to the Objector or the other children or seek their consent or renunciation prior to petitioning for grant.
  • In respect of the estate of Moses Muya Kagocha alias Muya Kakuya (Deceased), the distribution should be as per the certificate of confirmation of grant issued on 6/10/2010.
