Automated Summary

Key Facts

The Environment and Land Court in Kenya (ELC Case No. E071 of 2021) ruled on an application by Abdullahi Warame Ali and others to join a dispute over the Ismarriot Hotel and Resort. The applicants, claiming to be tenants in parts of the property leased from the 2nd Defendant, sought leave to participate as Interested Parties to protect their investments. The Plaintiffs (Mohamed Shariff Ali & Jamal Saleban Kariye) opposed the application, asserting the leases were fraudulent and the Interested Parties were not valid tenants. The court granted the application, determining the Interested Parties' claims needed adjudication alongside the existing parties' dispute.

Issues

  • The court's decision on whether to allow the Interested Parties to join the suit to resolve all legal questions and determine rights over the Suit Property.
  • Determining if the Interested Parties are necessary to the suit to enable the court to fully adjudicate on all matters and rights concerning the Suit Property.
  • Whether the Interested Parties' claims arise from the same act or transaction as the Plaintiffs' claims, thereby requiring their inclusion in the suit.

Holdings

The court allowed the application dated 19/3/2021 for the Interested Parties to join the suit, determining that their claims relating to parts of the Suit Property needed to be resolved within the same proceedings as the Plaintiffs' and Defendants' dispute. The court held that the Interested Parties are necessary to effectually adjudicate all questions regarding the Suit Property.

Remedies

  • The court allowed the application to join the Interested Parties as necessary parties to the suit, thereby enabling them to participate in the proceedings to protect their interests in the Suit Property.
  • The costs of the application shall be in the cause.

Legal Principles

The court applied the criteria for joining parties under Order 1 Rule 10 of the Civil Procedure Rules, determining that the Interested Parties had a necessary interest in the subject matter and that their absence would prejudice the complete adjudication of the dispute. The decision emphasized that interested parties must have a clearly identifiable interest in the subject matter and that their joinder is necessary to avoid adverse consequences to their rights.

Passage Text

  • Both the lease which the Plaintiffs seek to enforce and the one the proposed Interested Parties claim to have in place relate to the same Suit Property. In this court's view the Interested Parties' claim and interest over parts of the Suit Property would need to be determined as between the existing Plaintiffs and the Defendants and not in a separate suit.
  • The issue for determination in this application is whether the court should allow the Interested Parties to join this suit... Third parties such as the Interested Parties and others will definitely be affected by whatever orders the court may make both in the application dated 23/2/2021 and the suit.
  • The court allows the application dated 19/3/2021. The costs of the application shall be in the cause.
