Key Facts

Plaintiff Shane Joseph Boland Doyle failed to respond to the Court's March 24, 2025 order to show cause why mediation would not be appropriate, and subsequently failed to comply with the May 8, 2025 order to notify the court of continued interest in prosecuting the case. The Court dismissed the case sua sponte without prejudice on August 14, 2025 due to the plaintiff's failure to prosecute.

Issues

Whether the court should dismiss the case sua sponte due to Plaintiff Shane Joseph Boland Doyle's failure to respond to the Court's order to show cause regarding mediation and subsequent failure to comply with the May 8, 2025 order to notify the court of continued interest in prosecuting the case.

Holdings

This case is dismissed without prejudice because Plaintiff Shane Joseph Boland Doyle failed to comply with the Court's May 8, 2025 order to notify the Court of his continued interest in prosecuting the case. The Court had previously asked Doyle to provide notice because he failed to respond to a March 24, 2025 order to show cause why mediation would not be appropriate. As Doyle neither complied with the order nor requested additional time, the Court exercised its inherent power to dismiss the case sua sponte for failure to prosecute or comply with a court order.

Remedies

The court ordered dismissal of the case without prejudice and directed the Clerk to close the case file.

Legal Principles

District courts have inherent power to dismiss a case sua sponte for a plaintiff's failure to prosecute or otherwise comply with a court order, per LCvR 83.23.
