Automated Summary
Key Facts
The defendant Melitus Odero sought to strike out the plaintiffs' case, arguing it was res judicata based on a 2013 judgment (Kisumu HCCC no 69B of 1996) where he previously sued over land parcel Uholo/Ugunja/264. The plaintiffs, Mornica and Consolata Oduor, opposed this, asserting they were not parties to the earlier suit, not legal representatives of Wilson Oduor Ouma (a defendant in the 2013 case), and their current claim is distinct. The court deferred resolution of the res judicata issue due to uncertainty about the plaintiffs' relationship to Wilson Oduor Ouma, with the matter set for fast-tracked main hearing.
Issues
Whether the plaintiffs' claim over land parcel Uholo/Ugunja/264 is barred by res judicata, given a prior determination in Kisumu HCCC no 69B of 1996 where Wilson Oduor Ouma was a plaintiff against the defendant, and the plaintiffs argue they were not parties, legal representatives, or claimants in the prior case.
Holdings
The court deferred determination of the res judicata issue due to uncertainty about the plaintiffs' status as widows of Wilson Oduor Ouma from the prior 1996 case. The matter will be fast-tracked for a main hearing to resolve this and other legal issues.
Remedies
The court ruled that it is uncertain whether the plaintiffs are the widows of Wilson Oduor Ouma, deferring the res judicata issue for final determination. The matter has been fast-tracked for a main hearing to resolve the outstanding issues.
Legal Principles
The court considered the defense of res judicata, where the defendant argued that the current case was precluded by a prior judgment (Kisumu HCCC no 69B of 1996) involving the same land parcel and Wilson Oduor Ouma as a defendant. The plaintiffs countered that they were not parties to the earlier suit, their claim is distinct, and they are litigating under different titles. The judge deferred final determination on res judicata until the main hearing, citing uncertainty about the plaintiffs' relationship to Wilson Oduor Ouma.

Passage Text
- The defendant contended that the suit was res judicata since the issues had been determined on August 19, 2013 in Kisumu HCCC no 69B of 1996 between him as the plaintiff against several defendants. One such defendant was Wilson Oduor Ouma who was the plaintiffs' husband.
- For the reason I am at this point uncertain if the plaintiffs are the widows of Wilson Oduor Ouma, I have deferred determination of the issue of res judicata. This issue shall be determined when this court renders its final determination.
- They stated that they had not been parties in the previous suit, they were not the legal representatives or administrators of the estate of Wilson Oduor Ouma, their claim was different and they were litigating under different titles.
