- Dichiara estinto il giudizio di Cassazione.
- Ritenuto, pertanto, che - a norma dell'art. 380-bis, secondo comma, c.p.c. - il ricorso deve intendersi rinunciato e deve provvedersi a dichiarare l'estinzione del giudizio di cassazione ai sensi dell'art. 391 cod. proc. civ.
- Condanna la parte ricorrente al pagamento, in favore della parte controricorrente, delle spese del giudizio di legittimità, che liquida in Euro 2.200,00 per compensi, oltre alle spese forfettarie nella misura del 15%, agli esborsi liquidati in Euro 200,00 ed agli accessori di legge.
