Cassazione Civile - Ordinanza n. 02045/2026

Corte Suprema di Cassazione

Automated Summary

Key Facts

S.E.A. and CAD-Leo Antelli s.r.l. had a dispute over the application of tariffs for subconceding offices at Malpensa airport. The Tribunale di Milano ruled in 2019, and the Corte d'Appello di Milano partially reformed the decision in 2020. In 2023, S.E.A. withdrew its appeal against CAD, and the current judgment declares the case extinct between them, eliminating the need for further correction of the previous judgment.

Transaction Type

Sub-concession of office spaces at Malpensa airport

Issues

  • The Tribunal of Milan had declared CAD's right to specific tariff rates (€250/mq/year and €324.80-369.56/mq/year) for subconceded office spaces at Malpensa Airport, while the Court of Appeal partially upheld S.E.A.'s appeal regarding prescription periods.
  • The Court considered whether the claim for overpaid tariffs by Agility Logistics (now DSV) was time-barred for the period before March 20, 2010, and whether the correct tariff rates were applied for the subconcession of offices at Malpensa Airport.
  • The Court declared the legal proceedings extinguished following the mutual agreement of S.E.A. and CAD to withdraw the case, with CAD accepting the withdrawal without further legal costs.

Holdings

  • The current court declared the litigation between SEA and CAD extinguished following SEA's 2023 withdrawal of the appeal and CAD's acceptance of the withdrawal, rendering the requested correction of the 2014 extinction declaration unnecessary as the case is already resolved.
  • The Appellate Court of Milan (2020) partially granted SEA's appeal, declared Agility Logistics' right to restitution prescriptive for payments before March 20, 2010, and ordered SEA to pay €37,263.30 plus interest to Agility Logistics while Agility must refund SEA for overpayments in accordance with the first instance judgment.

Remedies

  • The Court declared S.E.A. s.p.a. must return €46,662.50, including legal interest and litigation costs, to CAD for overpaid tariffs in the period from 1.3.2012 to 29.2.2016 related to office sub-concession at Malpensa airport.
  • The Court of Cassation terminated the proceedings between S.E.A. and CAD after the parties jointly requested this on April 14, 2014, with CAD later accepting SEA's 2023 withdrawal of the appeal without further correction requests.
  • The Appellate Court found that Agility Logistics' (now DSV s.p.a.) right to reclaim overpaid amounts before March 20, 2010, was time-barred by prescription.

Legal Principles

The court relied on the principle of Res Judicata, which prevents the re-litigation of a matter that has already been finally decided by a court. This principle was used to declare the extinction of the legal proceedings between S.E.A. s.p.a. and CAD s.r.l., as both parties jointly requested the termination of the case.
