Key Facts

The High Court at Meru revoked James Kimathi Muthui's letters of administration for the estate of Eutycus Muthui (deceased) due to his failure to complete estate distribution as ordered. Despite multiple court directives, including an order empowering the Deputy Registrar to sign transfer forms on his behalf, the administrator refused to obtain discharge of charges from Standard Chartered Bank and African Bank Corporation Limited, delaying distribution. The court appointed Miriam Kendi Muthui, Catherine Kinya Muthui, and Joel Kithinji Muthui as joint administrators to expedite compliance with the March 2021 orders under Section 83 of the Law of Succession Act.

Issues

  • The court considered whether to revoke the administrator's letters of administration after he failed to comply with orders to distribute the estate, specifically refusing to sign transfer forms. This relates to the duty of personal representatives under the Law of Succession Act (Section 83) and the court's authority to address abuse of process.
  • The court evaluated the request to empower the Deputy Registrar to sign transfer forms in place of the administrator, who had not fulfilled his duties. This issue centered on the court's inherent authority to control its process and ensure compliance with orders, as referenced in precedents like Central Bank of Kenya vs. Ratilal Automobiles Limited.

Holdings

  • The order dated 18th March, 2021 empowering the Deputy Registrar to sign transfer forms on behalf of the Administrator is revoked and ceases to have effect following the new appointment of joint administrators.
  • Miriam Kendi Muthui, Catherine Kinya Muthui, and Joel Kithinji Muthui are appointed as joint administrators of the deceased's estate to ensure proper distribution.
  • The Applicants are directed to directly engage the respective banks (Standard Chartered Bank Meru and African Bank Corporation Limited) to obtain necessary documents for estate administration completion.
  • The court revokes the letters of administration previously issued to James Kimathi Muthui on 03rd October, 2012 due to his failure to complete the estate distribution as required by court orders and statutory duties under the Law of Succession Act.
