Key Facts
Deanna Robitille filed a petition on March 22, 2022, alleging a shoulder injury related to vaccine administration from an influenza vaccine received on October 15, 2020. The court previously awarded compensation on January 5, 2024. Petitioner requested $31,816.64 in attorney fees and costs, but the award was reduced to $31,110.54 (including $26,571.50 in fees and $4,539.04 in costs) after adjusting attorney Jubaile Abila's hourly rates. The costs were approved following a one-time courtesy extension to supplement documentation for expert Dr. Bedi's fees.
Issues
- The court reduced the fees requested by $706.10 by adjusting Ms. Abila's hourly rates to $289 for 2023 and $305 for 2024, based on prior determinations. The calculation was ($340 - $289 = $51 x 10.00 hrs.) + ($358 - $305 = $53 x 3.70 hr.) = $706.10.
- The court found Dr. Bedi's expert costs of $4,539.04 reasonable despite his hourly rate of $650, based on 9 hours of work. However, the rate was deemed too high for future Vaccine Program cases.
Holdings
- The court approved $4,539.04 in litigation costs, including $4,000.00 in expert costs for Dr. Asheesh Bedi, but explicitly disapproved his hourly rate of $650 for future cases. The decision emphasized the need for complete supporting documentation for expert costs, referencing the Vaccine Guidelines, and warned that future requests lacking such documentation may be curtailed or denied.
- The court granted in part the Petitioner's Motion for attorney's fees and costs, awarding a total of $31,110.54 (representing $26,571.50 in fees plus $4,539.04 in costs) to be paid to Petitioner's counsel's IOLTA account. The decision references the Vaccine Act's allowance for reasonable fees and costs for successful claimants (Section 15(e)) and explains the reduction in fees for attorney Jubaile Abila due to prior rate determinations. The court also addressed the approval of expert costs for Dr. Asheesh Bedi at $4,000.00, noting the rate was unacceptably high for future cases but reasonable in this instance.
- The court reduced the requested fees for attorney Jubaile Abila by $706.10, adjusting her rates to $289 per hour for 2023 and $305 per hour for 2024, consistent with a prior decision (Phoneprasith v. Sec'y of Health & Hum. Servs., No. 22-79V, Slip Op. 37). The reduction was based on the lesser rates previously awarded and the absence of justification for deviation.
Remedies

Legal Principles
- The petitioner bears the burden of establishing the hours expended, the rates charged, and the expenses incurred for attorney's fees and costs. This principle was applied in the context of the Vaccine Act, requiring Petitioner's counsel to provide contemporaneous and specific billing records to justify the requested fees.
- The court applied reasonableness standards to attorney's fees and costs, reducing excessive or unnecessary hours and adjusting hourly rates for a specific attorney based on prior determinations. Expert costs were evaluated for overall reasonableness despite objections to the requested hourly rate.

Passage Text
- The Vaccine Act permits an award of reasonable attorney's fees and costs for successful claimants. Section 15(e). Accordingly, I hereby GRANT in part, Petitioner's Motion for attorney's fees and costs. I award a total of $31,110.54 (representing $26,571.50 in fees plus $4,539.04 in costs) to be paid through an ACH deposit to Petitioner's counsel's IOLTA account for prompt disbursement.
- The hourly rates requested for attorney Jubaile Abila, however, require adjustment. Ms. Abila was previously awarded the lesser rates of $289 per hour for time billed in 2023 and $305 per hour for time billed in 2024. Application of the foregoing reduces the fees requested by $706.10.
- I find the overall amount requested reasonable in light of the work produced in this case. I do not however, endorse Dr. Bedi's hourly rate of $650 for future cases. Rather, I will award the sum requested based on the overall reasonableness of the amount and not on acceptance of the requested hourly rate...
