Kenya Law

Automated Summary

Key Facts

The case involves Stanbic Bank Limited (appellant) wrongfully debiting House of Diaspora Limited's (respondent) account in February 2023 and crediting the amount five months later on July 7, 2023. The High Court of Kenya, in its October 2, 2025 judgment, overturned the lower court's decision to award the principal amount. The court ruled that damages should only cover interest at court rates (Ksh 350,534.29) for the five-month period the funds were withheld, plus punitive costs of Ksh 10,000. The bank's unprofessional conduct in the wrongful debit was explicitly noted.

Transaction Type

Wrongful account debit by Stanbic Bank Limited

Issues

  • The court considered if punitive damages were warranted for the Appellant's unprofessional actions, concluding that such damages were appropriate given the wrongful debit and subsequent failure to promptly rectify the error.
  • The court addressed whether the lower court correctly awarded damages on the principal amount after the Appellant credited the Respondent's account, determining that general damages should have been limited to the five-month period the funds were wrongfully withheld, not the principal itself.

Holdings

  • The court found that the Appellant (Stanbic Bank Limited) wrongfully debited the Respondent's account and that the lower court erred by awarding damages on the principal amount rather than general damages for the five-month period during which the funds were withheld. The court further determined that the Appellant's unprofessional conduct justified punitive damages.
  • The court set aside the lower court judgment and replaced it with an award of interest at court rates (KES 350,534.29) for the five-month period, punitive costs of KES 10,000, and a directive that each party bear their own costs.

Remedies

  • Interest at court rates of KSh 350,534.29 for five months being the period in which the money was wrongly withheld by the Appellant
  • Punitive costs assessed at KSh 10,000
  • Each party to bear own costs

Monetary Damages

360534.29

Legal Principles

The court applied costs principles by awarding punitive costs of Ksh 10,000 and interest at court rates (Ksh 350,534.29) for the five-month period the funds were wrongly withheld. It emphasized that the lower court erred in awarding the principal amount instead of general damages for the period of wrongful retention.

Passage Text

  • Interest at Court rates of ksh 350534.29 for five months being the period in which the money was wrongly withheld by the Appellant.
  • This Court finds that the Appellant debited the Respondent account wrongly as it is admitted by both parties. Since the money has already been credited to the Respondent's account, the lower court ought to have restricted itself to general damages within the five months when the Respondent money was wrongly with the Appellant and not the principle amount. There is no clear prove on how the Respondent would have grown the wrongly debited amount. Secondly, by wrongly debiting the Respondent account, the Appellant acted unprofessionally and so the Respondent is entitled to punitive damages.

Damages / Relief Type

  • Each party to bear own costs
  • Punitive costs assessed at Ksh 10,000 for unprofessional conduct
  • Interest at court rates of Ksh 350,534.29 for five months (period of wrongful withholding)
