Automated Summary

Key Facts

Karen Unkel filed a medical malpractice action against Dr. Nguyen Nguyen, W.O. Moss Regional Medical Center, and the Louisiana Department of Health and Hospitals after sustaining injuries during a hospitalization at Moss Regional. Unkel was attacked by a fellow psychiatric patient (an inmate from the Calcasieu Parish jail) who sustained a serious blow to her head. She was initially diagnosed with soft tissue injuries, but after two years was diagnosed with a subdural hematoma attributed to the injury at Moss Regional. A medical review panel ruled that the defendants were liable in medical malpractice for the attack, though Dr. Nguyen was not held responsible as he was not the attacker's treating physician. The trial court granted summary judgment in Unkel's favor on liability and causation, awarding the statutory cap of $500,000.00 in damages. Both the defendants and Unkel appealed, but the Louisiana Court of Appeal affirmed the trial court's judgment.

Issues

  • The court addressed whether the plaintiff's damages clearly exceeded the statutory maximum of $500,000 in medical malpractice, which permits summary judgment. The court found that reasonable minds could not disagree with the conclusion that damages exceeded the cap, and affirmed the trial court's award of the statutory cap plus medical expenses.
  • The appellate court reviewed whether the trial court properly granted summary judgment against defendants on issues of liability and causation in a medical malpractice action involving patient injuries at W.O. Moss Regional Hospital. The court affirmed that the defendants failed to set forth specific facts revealing genuine issues for trial.
  • The plaintiff argued the trial court erred in dismissing Dr. Nguyen, but the appellate court noted that neither side formally requested his dismissal and the question of his fault was never litigated. Because the plaintiff did not formally answer the appeal as required by Louisiana Code of Civil Procedure, issues regarding Dr. Nguyen's dismissal remain final.

Holdings

The Louisiana Court of Appeal affirmed the trial court's summary judgment in Karen Unkel's medical malpractice case against W.O. Moss Regional Hospital and the Louisiana Department of Health and Hospitals. The court found the defendants failed to demonstrate genuine issues of material fact remained, and the trial court properly awarded the statutory maximum of $500,000 in damages. The court declined to address the dismissal of Dr. Nguyen as it was no longer before the court.

Remedies

The appellate court affirmed the trial court's summary judgment in favor of plaintiff Karen Unkel in her medical malpractice action against W.O. Moss Regional Hospital and the Louisiana Department of Health and Hospitals. The court upheld the trial court's award of the statutory $500,000 damage cap plus past and future medical expenses. Costs were assessed against the defendants W.O. Moss Medical Center and the Louisiana Department of Health and Hospitals.

Legal Principles

  • In medical malpractice cases, courts may resolve issues of liability and damages by summary judgment when appropriate. When a plaintiff's damages clearly exceed the statutory maximum of $500,000, summary judgment may be granted. An adverse party may not rest on mere allegations but must set forth specific facts showing a genuine issue for trial.
  • The prior judgment finding the State and hospital liable for breach of standard of care is a final judgment and not before the court for review. Issues regarding Dr. Nguyen's dismissal are no longer at issue as his dismissal is final.

Passage Text

  • In the present case, the defendants have failed to set forth any specific facts which would reveal a genuine issue for trial. In granting summary judgment, the trial court found Unkel had established clearly a prima facie case as to the extent of her damages. The court then found the defendants had not met their burden of proof in establishing that genuine issues of material fact remain. The court explained that reasonable minds could not disagree with the conclusion that Unkel's damages exceed the $500,000.00 cap, and the court awarded that amount plus past and future medical expenses.
  • For the above and foregoing reasons, the judgment of the trial court is affirmed. Costs are assessed to W.O. Moss Medical Center and the Louisiana Department of Health and Hospitals.
