Key Facts
Joseph Morara Omoke was employed as a Branch Manager by Invesco Assurance Co. Ltd. in June 2010, earning Shs. 72,000 monthly salary plus allowances. He was arrested in June 2011 on theft charges, acquitted in February 2012, and dismissed in August 2011 without a hearing. The employer's counterclaim was dismissed for lack of evidence.
Issues

- Whether the summary dismissal of the Claimant was unfair
Holdings
- The court determined that the summary dismissal of the Claimant was unfair as the employer failed to provide a hearing in accordance with Section 41 of the Employment Act. The Claimant was not given an opportunity to defend himself, and the grounds for dismissal were not proven, particularly since he was acquitted of the criminal charges related to the dismissal. The court also found the dismissal violated the procedural requirements for termination.
- The court ruled that the Claimant is entitled to remedies including 11 months' salary (Kshs. 1,115,719), 27 leave days (Kshs. 91,286.10), 6 months' compensation (Kshs. 608,574), and costs (Kshs. 50,000), totaling Kshs. 1,865,579.10. The Respondent's counterclaim was dismissed as no evidence was presented.

Legal Principles
The court applied the principle of natural justice, emphasizing that the employer failed to provide the claimant with a proper hearing before summary dismissal. Under Section 41 of the Employment Act, an employer must explain termination reasons and allow the employee to respond. The claimant's acquittal in the criminal case further demonstrated the lack of valid grounds for dismissal.

- RW3 Josephine Mbikuka, the Respondent's acting Human Resource Manager admitted in her testimony in court under cross examination that the Claimant was served with both the letter of interdiction and summary dismissal on 29th January, 2012.
- For these reasons I find that the summary dismissal of the Claimant did not meet both the standards for fair procedure and proof of reason for dismissal. The summary dismissal was therefore unfair.
