  • The applicant herein KHALDUN NOMBAMBA, has moved this court by way of Chamber Summons supported by affidavit. The application is preferred under section 18 (1) (2) and (3), section 19 (1) (2) of the Mental Health Act No. 1 of 2001 and Order XVIII Rule 3 and section 129 of the Civil Procedure Decree Cap 8 of the laws of Zanzibar. It is the view of this court that, the applicant as Donee of the Special Power of Attorney, has powers and authority granted to him under such Special Power of Attorney to present and protect the interest of the Donor (respondent) as his recognised agent when the respondent is suing or being sued, hence I see no justifiable legal reason to grant the applicant the orders sought. Having made such observations, this application lacks merits and it is hereby dismissed. It is so Ordered.

That, the court be pleased to grant an order appointing KHALDUN NOMBAMBA as a next friend of OTHMAN ISMAIL NOMBAMBA a person of unsound mind incapable of protecting his interest when suing or being sued. 2.
