Kenya Law

Automated Summary

Key Facts

Stanbic Bank Limited (appellant) wrongly debited House of Diaspora Limited's (respondent) account in February 2023 and credited the amount on July 7, 2023, after five months. Both parties admitted the error. The lower court awarded damages, but the appeal set aside this judgment, limiting compensation to interest at court rates (Ksh 350,534.29) for the five-month period and punitive costs (Ksh 10,000) due to the bank's unprofessional conduct.

Transaction Type

Wrongful debit by bank

Issues

  • The court considered the Appellant's unprofessional conduct in wrongly debiting the account and ruled that the Respondent was entitled to punitive damages. The Appellant's actions were deemed unprofessional, justifying the punitive costs awarded.
  • The court addressed whether the Appellant's wrongful debit of the Respondent's account required the Lower Court to award damages based on the period the money was withheld (five months) rather than the principle amount. The Appellant admitted the error and credited the account after five months, so the damages should have been limited to that period, not the full amount.

Holdings

  • Punitive costs assessed at Ksh 10,000 due to the Appellant's unprofessional conduct in wrongly debiting the Respondent's account.
  • Each party to bear their own costs following the Court's determination that the Appellant's actions did not warrant additional cost allocation beyond punitive damages.
  • Interest at Court rates of Ksh 350,534.29 for five months, representing the period in which the money was wrongly withheld by the Appellant.

Remedies

  • Each party to bear own costs
  • Punitive costs assessed at KSh 10,000
  • Interest at Court rates of KSh 350,534.29 for five months being the period in which the money was wrongly withheld by the Appellant

Monetary Damages

360534.29

Legal Principles

The court applied costs principles to award punitive costs of Ksh 10,000 due to the bank's unprofessional conduct in wrongfully debiting the respondent's account.

Passage Text

  • Interest at Court rates of ksh 350534.29 for five months being the period in which the money was wrongly withheld by the Appellant
  • This Court finds that the Appellant debited the Respondent account wrongly as it is admitted by both parties. Since the money has already been credited to the Respondent's account, the lower court ought to have restricted itself to general damages within the five months when the Respondent money was wrongly with the Appellant and not the principle amount. There is no clear prove on how the Respondent would have grown the wrongly debited amount. Secondly, by wrongly debiting the Respondent account, the Appellant acted unprofessionally and so the Respondent is entitled to punitive damages.

Damages / Relief Type

  • Interest at Court rates of Ksh 350,534.29 for five months of wrongful withholding
  • Punitive costs assessed at Ksh 10,000 for unprofessional conduct
  • Parties to bear their own costs
