Key Facts
Bilila Lodge Investment Limited (t/a Four Seasons Safari Lodge) applied for a revision against a Commission for Mediation and Arbitration award (CMA/ARS/ARS/47/19). The applicant's counsel, Mr. John Mushi, failed to file written submissions on 08/09/2022 and did not appear on the scheduled mention date. The respondent, Okuli Kinabo Kimaro, argued the failure to file submissions constituted non-prosecution, warranting dismissal. The applicant's counsel claimed illness prevented compliance, citing intent to seek a 10-day extension post-discharge. The court found no valid justification due to lack of medical proof, emphasizing adherence to court orders and rejecting the extension request. The application was dismissed on 2022-09-09 as a labour dispute originating case.
Issues
The court considered whether the Applicant's failure to file required written submissions on time constituted a failure to prosecute the application, warranting dismissal. The Applicant's counsel claimed illness as the reason for non-compliance but provided no medical evidence. The Respondent argued that unproven excuses for non-adherence to court orders risk setting a bad precedent and disrupting judicial efficiency. Legal precedents cited by both parties emphasized the necessity of strict compliance with court directives to maintain orderly proceedings and prevent justice delays.
Holdings
The court dismissed the Applicant's revision application due to their failure to file written submissions as ordered. The Applicant's counsel claimed illness prevented compliance but provided no evidence, leading the court to conclude there was no valid justification for non-compliance with procedural orders. The court emphasized adherence to court orders is essential to prevent chaos in the justice system and noted the Applicant's awareness of the deadlines.
Remedies
The court dismissed the Applicant's revision application after finding that the Applicant's counsel failed to file timely written submissions without sufficient justification. The judge determined there was no good reason for the non-compliance with court orders and ruled that the appropriate remedy was dismissal of the application.
Legal Principles
The court applied the principle that failure to comply with court orders without sufficient justification constitutes a failure to prosecute, warranting dismissal to maintain procedural integrity and prevent chaos in the justice system. This was reinforced by citing precedents emphasizing that court orders must be obeyed to ensure timely dispensation of justice.

Passage Text
- I agree with Mr. Materu that, there is no good and sound reason warranting the grant of the prayer by the counsel for the applicant. I say so because, the allegation that the counsel for the Applicant one Mr. Mushi is sick is a mere statement from Mr. Pendael not supported by any proof.
- "Now what is the effect of a court order that carries instructions which are to be carried out within a pre-determined period? Obviously, such an order is binding... Courts of law should always control proceedings, to allow such an act is to create a bad precedent and in turn will invite chaos."
- All being said and in considering the above decision, I find that the Applicant's counsel did not substantially convince this court on his failure to timely file the submission on support of application. As well agreed by both counsel the remedy is to dismiss the application which I proceed to do.
